STANDARDIZED OPERATING PROCEDURES

Pursuant to New York Real Property Law § 442-h, Cantor Pecorella maintains standardized operating procedures describing the prerequisites prospective homebuyers must meet before receiving brokerage services. The following procedures apply to prospective homebuyers working with Cantor Pecorella and its affiliated real estate professionals.

IDENTIFICATION

Cantor Pecorella does / does not require prospective homebuyers to provide identification before receiving services.
Where identification is requested, it may be required for purposes such as property access, building security, showing requirements, or verification requested by a property owner or managing agent.

EXCLUSIVE BUYER REPRESENTATION AGREEMENT

Cantor Pecorella does / does not require prospective homebuyers to enter into an exclusive buyer representation agreement before receiving services.
A written representation agreement may nevertheless be required in certain circumstances or before particular brokerage services are provided.

MORTGAGE PRE-APPROVAL / PROOF OF FUNDS

Cantor Pecorella does not require prospective homebuyers to provide a mortgage pre-approval before receiving services.

A seller, property owner, sponsor, managing agent, or listing representative may independently require mortgage pre-approval, proof of funds, or other financial qualification before permitting a showing, considering an offer, or proceeding with a transaction.

APPLICATION OF THESE PROCEDURES

These procedures are applied consistently to prospective homebuyers in accordance with applicable Fair Housing and anti-discrimination laws.
Individual properties, sellers, sponsors, managing agents, or other third parties may impose additional requirements that are outside Cantor Pecorella’s standardized procedures.

CHANGES TO THESE PROCEDURES

Cantor Pecorella may revise these procedures from time to time in accordance with applicable New York State requirements.

The current version of these procedures will be made publicly available on this website.
